1.1 These terms apply to prize competitions operated under the name Hunter of Grails by Hunter of Grails Group (the Promoter, we, us or our) through https://hunterofgrails.com (the Website).
1.2 Please read these terms, the relevant competition page and any significant conditions in the related advertising before entering. By submitting an entry, you agree to the terms that apply when your entry is accepted.
1.3 Each Competition is separate. Its page will describe the prize, entry price, opening and closing dates, maximum number of entries, any limit per person, the required skill or knowledge challenge, and any special conditions. A special condition applies only if clearly presented before entry and cannot remove rights that the law protects. Entry is through the paid online route described below.
2.1 You must be at least 18 and resident in a territory where entry is lawful. We may restrict particular competitions or prize deliveries to the territories stated prominently on the competition page. You are responsible for checking the law that applies where you live.
2.2 Our employees and people directly involved in administering or drawing a Competition may not enter it.
2.3 We may request reasonable proof of age, identity, residence, eligibility and authority to use a payment method. We may refuse an entry, suspend an account or disqualify an entrant where we reasonably believe that they have breached these terms, used false details or another person’s identity, interfered with the Website or draw, or acted fraudulently, unlawfully or abusively. We will act reasonably and explain a decision where practicable.
3.1 Create an account and keep your name, email address, postal address and telephone number accurate. Select the Competition and number of entries, complete the watch knowledge or skill challenge shown, check your details, accept these terms and follow the payment instructions.
3.2 Every Competition requires entrants to exercise genuine skill, knowledge or judgment. The watch challenge will be designed so that its difficulty is reasonably likely to discourage a significant proportion of people from entering or prevent a significant proportion of entrants from qualifying for the draw. We will assess the challenge against this standard before launching each Competition and retain appropriate records of its operation. Only entries that complete the required challenge correctly qualify for the draw. Payment alone does not qualify an entry. We accept an entry only when its payment has cleared, the challenge has been completed correctly and we have confirmed acceptance. A payment reversed or charged back may invalidate the related entry.
3.3 Unless the competition page prominently states a lower limit before entry, you may hold up to 50 entries per Competition, across all accounts. No entrant may exceed the displayed total number of available entries. Each valid qualifying entry has one chance in the draw for the prize to which it relates.
3.4 We cannot accept entries submitted after closing or when all available entry numbers have been allocated. If we take payment in error after closing, we will refund it to the original payment method. We are not responsible for delayed or incomplete transmissions caused by circumstances outside our reasonable control, but will administer entries we receive fairly.
4.1 A Competition opens and closes at the dates and times displayed on its page, or closes sooner if all available entries are taken. We will conduct the draw as soon as reasonably practicable after closing, normally within 48 hours. We will announce any change to draw timing promptly.
4.2 We will not extend a closing date merely because fewer entries than expected have been sold. We will change a date only where unavoidable circumstances outside our reasonable control, legal requirements, fraud or a technical problem make that necessary for fair administration. We will explain and publicise a material change promptly and take reasonable steps to avoid disadvantaging entrants.
4.3 We may suspend, close early or cancel a Competition where such circumstances make fair administration impossible. If an early draw remains fair, we will draw from all valid entries accepted before closure. If we cancel without a draw, we will refund paid entries to the original payment method, unless an entrant expressly elects account credit.
5.1 After closing, we will select a winning entry at random from all valid and eligible entries using RandomDraws.com or an equivalently independent random number generator. We will retain appropriate records of the draw and the entries included.
5.2 Draws are normally shown on our Instagram account. If a livestream is unavailable, we may conduct a recorded draw or announce another channel and will still preserve a verifiable record. The number range used must correspond to the valid entries in that Competition.
5.3 There is one first prize winner unless the competition page clearly describes additional prizes and how their winners will be selected. We may correct a demonstrable technical or human error in an award, acting reasonably and respecting applicable legal rights.
6.1 We will contact a winner by the email address and telephone number in their account, normally within 12 hours of the draw. Keep your details current and check your messages, including junk folders.
6.2 Before releasing a prize we may ask for reasonable proof of identity, age and eligibility, and evidence relating to the winning entry. We will make reasonable attempts to contact the winner. They must respond, accept the prize and provide reasonably requested information within 28 days of our first notification. If they do not, or are ineligible under these terms, we may draw an alternative winner by the same method after reasonable attempts to reach them.
6.3 We will arrange collection or agreed delivery after verification and normally award the prize within 30 days of acceptance. If circumstances outside our reasonable control delay this, we will explain the delay and arrange fulfilment as soon as reasonably possible.
6.4 To show that a valid award occurred, we may publish or make available the winner’s surname and county, subject to any objection or request to reduce that information. We may still provide relevant details to the Advertising Standards Authority where required.
7.1 The Competition page describes the watch and any accessories, documents, condition, provenance or other material features included in the prize. The stated prize will be awarded regardless of how many entries are sold. We will not substitute a percentage of ticket sales for an advertised watch prize.
7.2 A prize cannot be transferred or exchanged for cash unless an alternative is clearly offered on the competition page before entry. If circumstances outside our reasonable control make the advertised prize unavailable, we will provide a reasonable equivalent of equal or greater value and explain the change.
7.3 Unless the competition page states otherwise, the winner must collect the prize; we may agree delivery with the winner. Any unusual collection, delivery, customs or shipping condition must be made clear before entry. Risk passes to the winner on collection or completed delivery. The winner is responsible for insurance thereafter and for taxes, customs duties or import charges applicable in their territory, unless stated otherwise before entry.
7.4 We do not give any additional warranty beyond the prize description and any express warranty stated on the competition page. Nothing in these terms limits a statutory right that cannot lawfully be excluded.
8.1 We may invite winners to take part in photographs or video about the win. Participation is voluntary and is not a condition of receiving the prize unless a specific lawful requirement was clearly stated before entry.
8.2 We use personal data to administer Competitions, process payments, verify eligibility, prevent fraud, contact winners, fulfil prizes and meet legal obligations. We may share it with payment providers, fulfilment partners, service providers, advisers and authorities where reasonably necessary. 8.3 Entry does not require agreement to receive marketing. We will send email or text marketing only where permitted by applicable law, provide any required choice separately and offer a simple opt-out. We will obtain consent where required before using a winner’s image, video or social media identity for marketing.
9.1 Once a valid entry has been accepted, its fee is normally non-refundable, except where these terms provide otherwise or the law requires a refund. A cancelled Competition without a draw and a payment taken in error after closing will be refunded as described above.
9.2 We may offer an additional refund or account credit in exceptional circumstances. Account credit is optional where a monetary refund is due. Refund processing times may depend on the payment provider.
10.1 Do not use bots or automated entry methods, interfere with the Website or draw, introduce malicious code, or access another person’s account. Only valid entries recorded in our systems will be included in the draw; a display error alone does not create an entry.
10.2 We do not guarantee uninterrupted Website access and are not responsible for a failure of a device, network, payment service or other system outside our reasonable control. We will correct errors and administer Competitions fairly where possible.
10.3 Nothing excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability or consumer right that cannot lawfully be excluded. Subject to that, we are not liable for losses that were not reasonably foreseeable when an entry was accepted, arise from an entrant’s breach of these terms, or relate to an entrant’s business activities. Entrants are responsible for reasonably foreseeable losses caused by their fraud or material misuse of the Website, subject to our duty to mitigate loss.
11.1 We may update these terms for future Competitions by publishing a new version. The version applicable when an entry was accepted continues to govern that entry, except where the law requires a change or a change is necessary for fair administration and does not materially disadvantage the entrant.
11.2 If a provision is unenforceable, the remaining provisions remain effective. Delay in enforcing a right is not a waiver. English law governs these terms, subject to mandatory consumer rights in an entrant’s country of residence; a consumer may bring proceedings in a court that has jurisdiction under applicable law.
